AN ACT

RELATING TO MILITARY AFFAIRS; PROVIDING FOR THE ESTABLISHMENT OF A CANTEEN AT THE ONATE TRAINING CENTER COMPLEX IN SANTA FE; MAKING AN APPROPRIATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. ONATE TRAINING CENTER COMPLEX CANTEEN--ESTABLISHMENT--POWERS AND DUTIES--PROCEEDS--AUDITS.--

          A. The department of military affairs may establish a canteen at the Onate training center complex in Santa Fe for the morale, welfare and recreation of trainees and soldiers. The canteen shall be established in accordance with rules of the federal departments of the army and air force and the national guard governing nonappropriated fund morale, welfare and recreation activities. The department of military affairs shall adopt and promulgate rules to carry out the provisions of this section.

          B. The canteen shall:

                (1) be separate and apart from the state;

                (2) be self-sufficient and not receive any appropriations from the legislature;

                (3) establish a system of bookkeeping and accounting for the proper handling of money derived from its operations; and

                (4) establish bank accounts into which proceeds from sales and other income of the canteen are deposited and out of which obligations of the canteen are paid.

          C. The canteen may:

                (1) contract for goods and services; and

                (2) hire necessary employees, who shall not be state employees.

          D. No obligations or contracts of the canteen shall be considered to be obligations or contracts of the state.

          E. The department shall require an annual independent audit each year of the canteen's operations and may require other audits as necessary. Audits shall be submitted to the state auditor and the legislative finance committee within ten days of receipt by the department.

          F. Money derived from the operation of the canteen is appropriated to the department for the operations of the canteen and general welfare of soldiers and airmen of the New Mexico national guard.
