AN ACT

MAKING AN APPROPRIATION TO PROVIDE SALARY INCREASES FOR JUSTICES, JUDGES, MAGISTRATES, CHILD SUPPORT HEARING OFFICERS AND SPECIAL COMMISSIONERS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--

          A. Three million thirty-eight thousand eight hundred thirty-nine dollars ($3,038,839) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2008 to provide justices of the supreme court with a salary increase to one hundred thirty-one thousand three hundred ninety-four dollars ($131,394). Salary increases, pursuant to Section 34-1-9 NMSA 1978 and the judicial compensation plan, shall also be provided to:

                (1) the chief justice of the supreme court;

                (2) chief judges of the court of appeals, district courts and metropolitan courts and presiding magistrates of magistrate courts with three or more magistrates;

                (3) judges of the court of appeals, district courts, metropolitan and magistrate courts;

                (4) child support hearing officers; and

                (5) special commissioners.

          B. The salary increases shall be effective the first full pay period after July 1, 2007.

          C. Any unexpended or unencumbered balance remaining at the end of fiscal year 2008 shall revert to the general fund.
