Mr. Speaker:

    Your HEALTH AND GOVERNMENT AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 348

has had it under consideration and reports same WITHOUT RECOMMENDATION, amended as follows:

     1. On page 3, line 12, strike "September 1, 2007" and insert in lieu thereof "August 1, 2009".

     2. On page 5, line 18, strike "October 1, 2007" and insert in lieu thereof "September 1, 2009".

     3. On page 7, line 3, strike the ending quotation mark and between lines 3 and 4, insert the following new subsections:

          "C. The commission shall not interfere with the discretion, judgment or advocacy of a public defender office, a public defender contractor or an assigned counsel in the representation of individual cases.

          D. The commission shall not interfere with the duties of the chief public defender, such as the administration of the department, the allocation and distribution of resources, management of personnel and contracts and other duties set forth in Section 31-15-7 NMSA 1978."".

     4. On page 10, line 14, after "report" insert "and budget".

     5. On page 12, line 13, strike "2007" and insert in lieu thereof "2009".

     6. On page 12, line 15, strike "2008." and insert in lieu thereof "2010. Nothing in this act prohibits the commission from reappointing the current chief public defender.".,

and thence referred to the JUDICIARY COMMITTEE.
