Mr. Speaker:

    Your JUDICIARY COMMITTEE, to whom has been referred

HOUSE BILL 49, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 20, strike "a separate finding of fact, proved" and insert in lieu thereof ", in a hearing separate from the trial or guilty plea proceeding, it is proven".

     2. On page 1, line 22, strike ", shows".

     3. On page 1, line 23, after “was” insert “knowingly”.

     4. On page 1, line 25, strike "a specific" and insert in lieu thereof "the".

     5. On page 3, between lines 20 and 21, insert the following new paragraphs:

                "(14) felony criminal damage to property, pursuant to Section 30-15-1 NMSA 1978;

                (15) felony graffiti, pursuant to Section 30-15-1.1 NMSA 1978;".

     5. Renumber the succeeding paragraphs accordingly.
