Madam President:
Your CONSERVATION COMMITTEE, to whom has been referred
HOUSE ENERGY AND NATURAL RESOURCES COMMITTEE SUBSTITUTE FOR HOUSE BILL 48
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 2, line 13, after "servitude", strike the remainder of the line and insert in lieu thereof "on".
2. On page 3, line 11, strike "and".
3. On page 3, line 15, strike the period and insert in lieu thereof "; and".
4. On page 3, between lines 15 and 16, insert the following new subsection:
"J. "state agency" means an agency of the executive branch of government of this state.".
5. On page 5, strike lines 23 through 25 in their entirety and insert in lieu thereof the following new paragraph:
"(7) if the agency is not a state agency and the environmental response project is being implemented by a federal agency or its contractors, be approved and signed by the department of environment in its discretion;".
6. On page 9, line 24, after "Act", insert "; provided, however, that nothing in the Uniform Environmental Covenants Act shall prohibit the water quality control commission from requiring an environmental covenant as a condition of approval of the alternative abatement standard".
7. On page 10, line 6, before "copy" insert "recorded".
8. On page 11, line 1, before "copy" insert "recorded".,
and thence referred to the FINANCE COMMITTEE.
