A JOINT RESOLUTION

GRANTING PRIOR APPROVAL TO SELL LAND IN CARLSBAD, FARMINGTON, SANTA FE AND LAS CRUCES OWNED BY THE PROPERTY CONTROL DIVISION OF THE GENERAL SERVICES DEPARTMENT ON BEHALF OF THE LABOR DEPARTMENT.

 

     WHEREAS, Section 13-6-3 NMSA 1978 requires ratification and approval of any sale of state property for over one hundred thousand dollars ($100,000) in value; and

     WHEREAS, the property control division of the general services department has title to land and buildings at 3235 South Halagueno in Carlsbad, at 600 West Arrington in Farmington, at 301 West De Vargas street in Santa Fe and at 226 South Alameda in Las Cruces; and

     WHEREAS, the buildings on the property are used as offices open to the public by the employment security division of the labor department; and

     WHEREAS, the employment security division desires to co-locate its offices into one-stop centers to provide seamless services to job seekers; and

     WHEREAS, the current buildings do not have sufficient space for all necessary partners; and

     WHEREAS, the labor department desires that the properties be sold; and

     WHEREAS, House Joint Resolution 12 of the second session of the forty-sixth legislature authorizes the sale of the property in Santa Fe, but the labor department desires that the county of Santa Fe have a right of first refusal in purchasing the property; and

     WHEREAS, although the property control division holds the title to the properties, the United States department of labor paid for the buildings and owns the equity in the property;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the property control division of the general services department be authorized to sell the described property; and

     BE IT FURTHER RESOLVED that the state-owned property shall not be sold for less than the value of the property established by the taxation and revenue department using generally acceptable appraisal techniques for this type of property; and

     BE IT FURTHER RESOLVED that the county of Santa Fe have a right of first refusal to purchase the property in Santa Fe; and

     BE IT FURTHER RESOLVED that the property control division of the general services department consult with the United States department of labor as to the disposition of sale proceeds; and

     BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the property control division of the general services department, the labor department, the county of Santa Fe and the United States department of labor.
