A JOINT RESOLUTION
GRANTING PRIOR APPROVAL FOR THE LEASE OF A PARCEL OF STATE-OWNED LAND TO A NONPROFIT CORPORATION FOR THE PURPOSE OF DEVELOPING AND MANAGING HOUSING ON THE LAND FOR CORRECTIONS DEPARTMENT EMPLOYEES AND OTHER STATE-SPECIFIED GOVERNMENTAL EMPLOYEES.
WHEREAS, Section 13-6-3 NMSA 1978 requires ratification and approval of any lease of state-owned property for more than twenty-five years; and
WHEREAS, the corrections department wishes to work in conjunction with the New Mexico mortgage finance authority under its workforce housing development program to conduct a comprehensive feasibility analysis to determine the feasibility of developing housing on state-owned property leased to a nonprofit corporation for the purpose of housing corrections department employees and, potentially, other government employees; and
WHEREAS, under such a plan, the employees of the corrections department and other government employees may have housing at a price significantly lower than market; and
WHEREAS, the state owns land in Santa Fe county situated in Section 35, Township 16 North, Range 8 East, New Mexico Principal Meridian, commonly known as the penitentiary of New Mexico, that is available for leasing; and
WHEREAS, the land will be leased to a state-controlled nonprofit corporation, whose limited purpose will be to develop and manage housing on the land for corrections department and other state-specified governmental employees providing essential services to the public; and
WHEREAS, the corporation may pledge the land as collateral for loans providing funds to pay the costs of pre-development and development of the housing project;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the property control division of the general services department be authorized to lease approximately fifty acres of the described property at the penitentiary of New Mexico in Santa Fe county for a period not exceeding ninety-nine years to a state-controlled nonprofit corporation for the sole purpose of providing housing to corrections department and other governmental employees; and
BE IT FURTHER RESOLVED that the lease be contingent on the completion of a feasibility analysis that shows that the lease and proposed use of the property is in the best interest of the state; and
BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the property control division of the general services department, the corrections department and the New Mexico mortgage finance authority.
