A JOINT MEMORIAL
REQUESTING THE REGULATION AND LICENSING DEPARTMENT TO CREATE A TASK FORCE TO MAKE RECOMMENDATIONS ON REGULATORY REFORM.
WHEREAS, the state should create a regulatory environment that enhances confidence, promotes accountability and ensures consistency in administrative actions; and
WHEREAS, businesses across the state would be better served by a regulatory environment that allows for planning and reasonable expectations when attempting to comply with regulatory statutes and rules;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the regulation and licensing department be requested to establish a task force to study regulatory reform, consisting of an equal number of members from regulatory agencies and from regulated licensees and permitees or their representatives; and
BE IT FURTHER RESOLVED that the regulatory reform task force be requested to make recommendations, including recommendations on possible legislation, dealing with the following issues:
A. developing time frames for granting or denying licenses and permits;
B. establishing limitation periods for pursuing enforcement actions on licenses and permits;
C. creating uniform inspection procedures for licenses and permits;
D. exploring whether application of the Administrative Procedures Act to all rulemaking and adjudicatory proceedings is desirable;
E. enhancing publication of rules, procedures and decisions regarding permits and licenses; and
F. whether hearing officers and administrative law judges should be employed by an independent executive agency or pooled within an existing executive agency for use upon request by other administrative agencies; and
BE IT FURTHER RESOLVED that the regulatory reform task force be requested to report its recommendations for consideration to the legislative finance committee no later than October 15, 2006; and
BE IT FURTHER RESOLVED that a copy of this memorial be transmitted to the superintendent of regulation and licensing.
