SUMMARY
Synopsis of Bill
Senate Bill 303 appropriates $500 thousand from the general fund to the Local Government Di-
vision (LGD) of the Department of Finance and Administration (DFA) in FY07 to provide ser-
vices at the Women’s Health Services (WHS) facility in Santa Fe.
FISCAL IMPLICATIONS
The appropriation of $500 thousand contained in this bill is a recurring expense to the general
fund. Any unexpended or unencumbered balance remaining at the end of FY07 would revert to
the general fund.
SIGNIFICANT ISSUES
DOH noted this appropriation would be in addition to any award from the competitive statewide

Rural Primary Health Care Act (RPHCA) RFP process. Women’s Health Services received
$300.0 in competitive RPHCA funds in FY06.
DFA indicated WHS is a 501C(3) community service agency that has been providing health ser-
vices to residents in Santa Fe since 1973. WHS provides primary medical care, behavioral
health, and alternative health care services. The funds, if appropriated will cover operating ex-
penses of the WHS. The facility would like to continue providing a comprehensive center of ex-
cellence for women's health, as well provide services to low income patients and/or disabilities.
WHS has five (5) components of services: 1) outreach/public health education 2) professional
education 3) provide leadership for out patients, staff and healthcare providers 4) provide direct
healthcare services and 5) participate in medical research for women's health initiatives.
DFA had concerns that this appropriation to WHS raises issues with the New Mexico Anti-
Donation Clause and with the competitive review process established by the DOH-Primary Care
and Rural Health pursuant to the provisions of the Rural Primary Health Care Act. Currently,
LGD/DFA has capital outlay appropriations in the amount of $545,000 for WHS, however, the
New Mexico Anti-Donation Clause affects these projects. The city nor the county of Santa Fe
does not own or operate WHS. DFA suggested that one option would be for the City of Santa Fe
to administer the funds.
ADMINISTRATIVE IMPLICATIONS
DFA indicated this appropriation raises anti-donation issues of administration. If the city of
Santa Fe can provide proof of an agreement with WHS, then it's possible LGD/DFA would ad-
minister this project. Otherwise, it may be better to amend language for DOH Primary Care to
administer these funds.
TECHNICAL ISSUES
DFA is concerned that the bill violates the anti-donation clause as structured.
