SUMMARY
Synopsis of Bill
Senate Bill 225 amends Section 8-15-18 NMSA 1978, which relates the Guadalupe Hidalgo
Treaty Division of the Office of the Attorney General, to require that the AG report the findings
and recommendations of the division to the legislature on an annual basis.
FISCAL IMPLICATIONS
The additional reporting requirement would entail a minimal fiscal and administrative impact to
the Office of the Attorney General.
SIGNIFICANT ISSUES
Article 2, Section 5 of the Constitution of New Mexico guarantees that the rights, privileges and
immunities, civil, political and religious guaranteed to the people of New Mexico by the Treaty
of Guadalupe Hidalgo shall be preserved inviolate.
According to the AG’s analysis, “the general incorporation by reference of federal law into the
statutory law of New Mexico may be subject to legal attack”.

WHAT WILL BE THE CONSEQUENCES OF NOT ENACTING THIS BILL
Should this legislation not be enacted, the citizens of New Mexico will not enjoy an annual re-
port of accountability from the Office of the Attorney General ensured to them by the spirit of
Article 2, Section 5 of Constitution of New Mexico.
