SUMMARY
Synopsis of Bill
Senate Bill 147 appropriates $1,400,000 from the general fund to the Public Education Depart-
ment (PED) to support the Engaging Latino Communities for Education (ENLACE) program.
FISCAL IMPLICATIONS
The appropriation of $1,400,000 contained in this bill is a recurring expense to the general fund.
Any unexpended or unencumbered balance remaining at the end of fiscal year 2007 shall revert
to the general fund.
SIGNIFICANT ISSUES
The legislature is considering multiple proposals to fund ENLACE programs at both the secon-
dary and post-secondary level. Some funding for this program is also included in the General

Appropriation Act.
ADMINISTRATIVE IMPLICATIONS
PED reports that ENLACE is not exempt from competitive procurement procedures and, there-
fore, PED would have to issue a Request for Proposal for these funds. PED would be required to
administer the RFP process and write and monitor a contract with ENLACE. PED states that
this process takes approximately 200 hours of staff time (Educator Administrator-A @
$25.49/hour X 200 hours plus benefits @ 30%). The total administrative cost is estimated at
$6,600.
CONFLICT, DUPLICATION, COMPANIONSHIP, RELATIONSHIP
Senate Bill 147 and Senate Bill 418 are duplicate measures.
This bill is related to Senate Bills 35 and 36 and House Bills 169 and 209, all of which appropri-
ate funds to higher education institutions for ENLACE programs. The General Appropriation
Act also includes base funding for ENLACE programs at higher education institutions.
TECHNICAL ISSUES
PED suggests that the bill should be amended on line 17 to allow the funds to be expended for
“ENLACE type programs.
OTHER SUBSTANTIVE ISSUES
ENLACE is a multi-year initiative to strengthen the educational pipeline and increase opportuni-
ties for Latinos to enter and complete college. By 2007, the W.K. Kellogg Foundation is ex-
pected to invest more that $35 million in the ENLACE initiative. The three New Mexico
ENLACE partnerships are among 13 that have been established in seven states.
ENLACE has evolved in three phases. In Phase 1, eighteen higher education institutions re-
ceived one-year planning grants of $100,000 to respond to the needs of students and families by
developing action plans based on best practices as well as local contexts. For Phase II, thirteen
partnerships received grants ranging from $1.4 million to $2 million to implement their plans
over four years. Implementation funding ended with the 2004-05 school year. A third phase will
seek to sustain promising practices and ENLACE principles for the benefit of more Latino com-
munities and underserved student populations.
This legislation would provide state general fund support for ENLACE programs within New
Mexico public schools.

How many school districts might receive funding for ENLACE programs through the RFP proc-
ess proposed by PED.
