SUMMARY

Synopsis of Bill

Senate Bill 36, sponsored by Senator Nava for the Legislative Education Study Committee, ap-

propriates a total of $1,200,000 from the general fund to support Engaging Latino Communities

for Education (ENLACE) programs at the University of New Mexico, New Mexico State Uni-

versity and Santa Fe Community College. An appropriation of $400,000 is made to each institu-

tion for this purpose.

FISCAL IMPLICATIONS

The appropriations totaling $1,200,000 contained in this bill are recurring expenses to the gen-

eral fund. Any unexpended or unencumbered balances remaining at the end of fiscal year 2007

shall revert to the general fund.

A total of $807,500 was appropriated for ENLACE programs in Chapter 34, Laws of 2005 (Sen-

ate Bill 190.) Some $712,500 of this total was appropriated to the Higher Education Department

(HED) for distribution to UNM, NMSU and SFCC. The remaining $95,000 was appropriated

directly to UNM. The Legislative Finance Committee funding recommendation for fiscal year

2007 has included these amounts as a component of block-grant appropriations to HED and

UNM for special project expansion. The Executive also recommends continued funding of these

programs as separate line-item appropriations. Therefore, approval of the appropriations in this

bill would result in the augmentation of the fiscal year 2007 funding proposed for HB 2.

SIGNIFICANT ISSUES

The appropriations contained in this bill are intended to help sustain the three New Mexico

ENLACE partnerships established through W.K. Kellogg Foundation grants as briefly described

below. The implementation grants ended with the 2004-05 fiscal year.

CONFLICT, DUPLICATION, COMPANIONSHIP, RELATIONSHIP

Senate Bill 36 and House Bill 209 are duplicate measures.

This bill relates to Senate Bill 35 and House Bill169. These are duplicate bills that propose fund-

ing in the amount of $300,000 specifically for the NMSU ENLACE partnership.

This bill also relates to proposed line-item appropriations in the General Appropriation Act for

ENLACE programs as noted in the fiscal implications section of this report.

OTHER SUBSTANTIVE ISSUES

ENLACE is a multi-year initiative to strengthen the educational pipeline and increase opportuni-

ties for Latinos to enter and complete college. By 2007, the W.K. Kellogg Foundation is ex-

pected to invest more that $35 million in the ENLACE initiative. The three New Mexico

ENLACE partnerships are among 13 that have been established in seven states.

ENLACE has evolved in three phases. In Phase 1, eighteen higher education institutions re-

ceived one-year planning grants of $100,000 to respond to the needs of students and families by

developing action plans based on best practices as well as local contexts. For Phase II, thirteen

partnerships received grants ranging from $1.4 million to $2 million to implement their plans

over four years. Implementation funding ended with the 2004-05 school year. A third phase will

seek to sustain promising practices and ENLACE principles for the benefit of more Latino com-

munities and underserved student populations.

This legislation would provide state general fund support to replace the Kellogg funding for the

three ENLACE partnerships in New Mexico.
