SUMMARY

Synopsis of Bill

Senate Bill 35 appropriates a $300,000 from the general fund to support the Engaging Latino

Communities for Education (ENLACE) program at New Mexico State University (NMSU).

FISCAL IMPLICATIONS

The appropriation of $300,000 contained in this bill is a recurring expense to the general fund.

Any unexpended or unencumbered balance remaining at the end of fiscal year 2007 shall revert

to the general fund.

For fiscal year 2006, the NMSU ENLACE program received one-third of a $712,500 appropria-

tion to the Higher Education Department for ENLACE programs in Chapter 34, Laws of 2005

(Senate Bill 190). The Legislative Finance Committee funding recommendation for fiscal year

2007 has included the $712,500 as a component of a block-grant appropriation to HED for spe-

cial project expansion. The Executive also recommends continued funding at the $712,500 level

as a line-item appropriation to HED. Therefore, approval of this bill would likely result in the

augmentation of the fiscal year 2007 funding proposed for ENLACE in HB 2.

SIGNIFICANT ISSUES

The appropriation contained in this bill is intended to help sustain the southern New Mexico

ENLACE partnership established through a W.K. Kellogg Foundation grant as briefly described

below. The implementation grant ended with the 2004-05 fiscal year.

CONFLICT, DUPLICATION, COMPANIONSHIP, RELATIONSHIP

Senate Bill 35 and House Bill 169 are duplicate measures.

This bill relates to Senate Bill 36 and House Bill 209. These are duplicate Legislative Education

Study Committee-sponsored bills that propose funding in the amount of $1,200,000 for the three

ENLACE partnerships in New Mexico. Some $400,000 of this total would be appropriated to

NMSU.

This bill also relates to a proposed line-item appropriation in the General Appropriation Act for

ENLACE programs as noted in the fiscal implications section of this report.

OTHER SUBSTANTIVE ISSUES

ENLACE is a multi-year initiative to strengthen the educational pipeline and increase opportuni-

ties for Latinos to enter and complete college. By 2007, the W.K. Kellogg Foundation is ex-

pected to invest more that $35 million in the ENLACE initiative. The three New Mexico

ENLACE partnerships, including the one at NMSU, are among 13 that have been established in

seven states.

ENLACE has evolved in three phases. In Phase 1, eighteen higher education institutions re-

ceived one-year planning grants of $100,000 to respond to the needs of students and families by

developing action plans based on best practices as well as local contexts. For Phase II, thirteen

partnerships received grants ranging from $1.4 million to $2 million to implement their plans

over four years. Implementation funding ended with the 2004-05 school year. A third phase will

seek to sustain promising practices and ENLACE principles for the benefit of more Latino com-

munities and underserved student populations.

This legislation would provide state general fund support to replace the Kellogg funding for the

ENLACE partnership at New Mexico State University. This program serves students at Santa

Theresa and Mayfield high schools.
