AN ACT

RELATING TO FAMILIES; REQUIRING STATE AGENCIES TO CREATE A FAMILY IMPACT REPORT TO ASSESS THE IMPACT ON FAMILIES OF PROPOSED LEGISLATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. FAMILY IMPACT REPORTS.--

          A. In keeping with the state's responsibility to develop plans that support the well-being of New Mexico families as provided in the Family Preservation Act, agencies in all three branches shall create a family impact report to assess the impact on families of proposed legislation.

          B. The family impact report shall assess whether the proposed legislation supports family preservation goals, including whether the proposed legislation:

                (1) supports intact and functional families;

                (2) strengthens families in crisis;

                (3) promotes creation of stable jobs; and 

                (4) helps to halt the breakup of the nuclear family, stabilizes neighborhoods and strengthens communities.

          C. Agencies required to create a family impact report shall include:

                (1) the administrative office of the courts;

                (2) the legislative finance committee; and

                (3) these executive departments: the public education department; the higher education department; the children, youth and families department; the economic development department; the human services department; the corrections department; the labor department; the department of environment; the cultural affairs department; the health department; and the department of public safety.

          D. The agencies listed in Subsection C of this act shall generate a family impact report and submit it to the legislature for its consideration with any fiscal impact report generated.
