AN ACT
RELATING TO JAILS; IMPOSING A FEE ON MUNICIPALITIES FOR MUNICIPAL PRISONERS HOUSED IN COUNTY JAILS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of Chapter 33, Article 3 NMSA 1978 is enacted to read:
"[NEW MATERIAL] COUNTY JAILS--FEE FOR MUNICIPAL PRISONERS.--In a class A county with a population of more than three hundred thousand persons, municipalities shall pay a fee to the board of county commissioners for each prisoner housed in a county-owned jail charged with municipal offenses or arrested by municipal officers. The fee shall be a reasonable fee established by the board of county commissioners and approved by the local government division of the department of finance and administration."
