AN ACT
RELATING TO GOVERNMENTAL CONDUCT; LIMITING THE AMOUNT OF PUBLIC FUNDS EXPENDED FOR ADVERTISEMENTS OR PUBLIC SERVICE ANNOUNCEMENTS BY ELECTED OFFICIALS; PRESCRIBING PENALTIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of the Governmental Conduct Act is enacted to read:
"[NEW MATERIAL] ADVERTISING OR PUBLIC SERVICE ANNOUNCEMENTS--ENFORCEMENT.--
A. No more than a combined total of one hundred fifty thousand dollars ($150,000) in state funds and federal funds appropriated to a state agency shall be expended annually to produce, broadcast or otherwise disseminate on television or radio an advertisement or public service announcement containing the name, voice, image or likeness of any one elected state officer.
B. Enforcement of the provisions of this section shall be in accordance with the provisions of Subsection A of Section 10-16-14 NMSA 1978 and Sections 10-14-17 and 10-14-18 NMSA 1978."
