Your JUDICIARY COMMITTEE, to whom has been referred
SENATE BILL 196, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. Strike all senate rules committee amendments.
2. On page 1, lines 12 and 13, strike "CERTAIN ELECTED OFFICIALS" and insert in lieu thereof "STATE PUBLIC OFFICERS AND EMPLOYEES".
3. On page 1, line 13, after the semicolon insert "LIMITING CERTAIN CONTRIBUTIONS FROM LOBBYISTS AND THEIR EMPLOYERS;".
4. On page 1, line 22, after "for" strike the remainder of the line, strike line 23 and on line 24, strike "attorney general" and insert in lieu thereof "a state public officer".
5. On page 1, line 24, strike "one of" and on line 25, strike "those positions" and insert in lieu thereof "state public office".
6. On page 2, line 7, after "to" strike the remainder of the line, strike line 8 in its entirety and on line 9, strike "general" and insert in lieu thereof "a state public officer".
7. On page 2, line 9, strike "one of those" and on line 10, strike "positions" and insert in lieu thereof "state public office".
8. On page 2, line 16, after "for" strike the remainder of the
line and insert in lieu thereof "state public office".
9. On page 3, line 1, after "equally" insert ", de minimis gifts worth a total of twenty dollars ($20.00) or less in any calendar year".
10. On page 3, line 2, strike "and".
11. On page 3, between lines 2 and 3, insert the following paragraph to read:
"(2) "candidate" means an individual who seeks or considers an office in an election covered by the Campaign Reporting Act, including a public official, who either has filed a declaration of candidacy or nominating petition or:
(a) for a non-statewide office, has received contributions or made expenditures of one thousand dollars ($1,000) or more or authorized another person or campaign committee to receive contributions or make expenditures of one thousand dollars ($1,000) or more for the purpose of seeking election to the office; or
(b) for a statewide office, has received contributions or made expenditures of two thousand five hundred dollars ($2,500) or more or authorized another person or campaign committee to receive contributions or make expenditures of two thousand five hundred dollars ($2,500) or more for the purpose of seeking election to the office or for candidacy exploration purposes in the years prior to the year of the election;".
12. Renumber the succeeding paragraph accordingly.
13. On page 3, line 11, strike the period and quotation mark and insert in lieu thereof "; and".
14. On page 3, between lines 11 and 12, insert the following to read:
"(4) "state public officer" means any person who has been elected to or appointed to any state elective office and who receives compensation in the form of salary or is eligible for per diem or mileage, but excludes judges."
Section 2. A new section of the Lobbyist Regulation Act is enacted to read:
"[NEW MATERIAL] LOBBYISTS--GIFTS PROHIBITED.--
A. A lobbyist or lobbyist's employer shall not give anything of value to a state public officer, other than a political contribution, and a state public officer, or agent acting on behalf of a state public officer, shall not solicit or accept anything of value from a lobbyist or lobbyist's employer, other than a political contribution.
B. For the purposes of this section, "anything of value" does not include de minimis gifts worth a total of twenty dollars ($20.00) or less in any calendar year."".
