AN ACT

RELATING TO LIBRARIES; CREATING THE RURAL LIBRARY DEVELOPMENT FUND; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. RURAL LIBRARY DEVELOPMENT FUND--CREATED.--

          A. The "rural library development fund" is created in the state treasury consisting of appropriations; other revenue credited to the fund; gifts, grants and donations; and income from investment of the fund. Money in the fund shall not revert to the general fund at the end of a fiscal year. The fund shall be administered by the library division of the cultural affairs department and money in the fund is appropriated to the division to carry out the purposes of the fund. Disbursements from the fund shall be by warrant of the secretary of finance and administration on vouchers signed by the state librarian or the state librarian's authorized representative.

          B. Money in the fund shall be used for rural library development, including expenses associated with library planning and the purchase of library materials, equipment and furniture. The library division shall promulgate rules on how money from the fund shall be allocated and what development expenses qualify for funding.

     Section 2. APPROPRIATION.--Two million dollars ($2,000,000) is appropriated from the general fund to the rural library development fund for expenditure in fiscal year 2006 and subsequent fiscal years to carry out the purposes of the fund. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
