Mr. Speaker:

 

    Your ENERGY AND NATURAL RESOURCES COMMITTEE, to whom has been referred

 

HOUSE BILL 410

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

1. On page 1, line 11, strike "A SECTION" and insert in lieu thereof "SECTIONS".

 

     2. On page 5, lines 23 and 24, strike "to be deposited to the credit of the hazardous waste fund,".

 

     3. On page 7, between lines 4 and 5, insert the following new section:

 

     "Section 2. Section 74-4-4.5 NMSA 1978 (being Laws 1987, Chapter 179, Section 7, as amended) is amended to read:

 

     "74-4-4.5. HAZARDOUS WASTE FUND CREATED--APPROPRIATION.--

 

          A. There is created in the state treasury the "hazardous waste fund", which shall be administered by the [division] department. All balances in the fund are appropriated to the [division] department for the sole purpose of meeting necessary expenses in the administration and operation of the hazardous waste program.

 

          B. All fees collected pursuant to [Subsection F of] Section 74-4-4.2 NMSA 1978 shall be transmitted to the state treasurer for credit to the hazardous waste fund."".

 

     4. Renumber the succeeding section accordingly.

 

     5. On page 7, line 3, strike “lieu of some or all of”, and insert in lieu thereof “addition to”.

 

     6. On page 7, line 4, after the period insert “Voluntary fee agreement shall include fees required by Subsection J of this section.”.,

 

 

 

and thence referred to the BUSINESS AND INDUSTRY COMMITTEE.
