AN ACT
MAKING APPROPRIATIONS FOR SALARY INCREASES FOR PUBLIC OFFICERS AND EMPLOYEES, PUBLIC SCHOOL PERSONNEL AND HIGHER EDUCATION FACULTY AND EMPLOYEES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. APPROPRIATIONS.--
A. Thirty-five million six hundred eighty-six thousand five hundred four dollars ($35,686,504) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2007 to provide salary increases to employees in budgeted positions, subject to satisfactory job performance. The salary increases shall be effective the first full pay period after July 1, 2006 and the appropriation shall be distributed as follows:
(1) one million four hundred ten thousand one hundred ninety-six dollars ($1,410,196) to provide the justices of the supreme court with a salary increase to one hundred fifteen thousand forty dollars ($115,040) and to provide the chief justice of the supreme court; the chief judge of the court of appeals; judges of the court of appeals, district courts, metropolitan courts and magistrate courts; child support hearing officers; and special commissioners with a salary increase pursuant to the provisions of Section 34-1-9 NMSA 1978;
(2) three million one hundred fifty-five thousand eight hundred sixty dollars ($3,155,860) to provide all judicial permanent employees, other than employees whose salaries are set by statute, with an average five percent salary increase as determined by the administrative office of the courts;
(3) eighty-one thousand nine hundred fifty-five dollars ($81,955) to provide a five percent salary increase for district attorneys;
(4) two million one hundred thirty-six thousand four hundred twenty dollars ($2,136,420) to provide all district attorney permanent employees, other than elected district attorneys, with a salary increase equivalent to a two percent salary increase and an average three percent compa-ratio adjustment as determined by the administrative office of the district attorneys;
(5) twenty-two million seven hundred eighty-four thousand nine hundred forty-four dollars ($22,784,944) to provide incumbents in agencies governed by the Personnel Act with a two percent salary increase and an average three percent compa-ratio adjustment as determined by the state personnel office;
(6) one million six hundred forty-two thousand five hundred sixty-two dollars ($1,642,562) to provide executive exempt employees, including attorney general employees and workers' compensation judges, with an average five percent salary increase;
(7) three million one hundred twenty-seven thousand eight hundred forty-six dollars ($3,127,846) to provide all commissioned officers of the New Mexico state police division of the department of public safety with a five percent general salary increase and an additional five percent to address compaction issues for those officers below the rank of lieutenant in accordance with the New Mexico state police career pay system as determined by the secretary of public safety;
(8) two hundred ninety thousand six hundred twenty-three dollars ($290,623) to provide teachers in the department of health; corrections department; children, youth and families department; and commission for the blind with a four and one-half percent salary increase and for statutory minimum salaries for level three-A teachers;
(9) five hundred two thousand one hundred thirty dollars ($502,130) to provide permanent legislative employees, including permanent employees of the legislative council service; the legislative finance committee; the legislative education study committee; legislative building services; the house and senate chief clerks' offices; and the house and senate leadership, with an average five percent salary increase; and
(10) five hundred fifty-three thousand nine hundred sixty-eight dollars ($553,968) for an additional three percent salary increase for state employees classified as probation and parole officers; librarians, library technicians and library assistants; and police, fire and ambulance dispatchers.
B. The following amounts are appropriated from the general fund to the higher education department for expenditure in fiscal year 2007:
(1) thirty-nine million nine hundred fifty-six thousand seven hundred dollars ($39,956,700) to provide faculty and staff of four- and two-year public post-secondary educational institutions with a four and one-half percent compensation increase; and
(2) five million seven hundred eight thousand one hundred dollars ($5,708,100) to provide a three-fourths percent increase in the employer contribution to the educational retirement fund. The compensation increase shall be effective the first full pay period after July 1, 2006.
C. The following amounts are appropriated from the general fund to the public education department for expenditure in fiscal year 2007:
(1) eighty-one million three hundred twenty-nine thousand nine hundred twenty-seven dollars ($81,329,927) to provide all public education employees with a four and one-half percent salary increase;
(2) seven million four hundred ninety-six thousand nine hundred one dollars ($7,496,901) for statutory minimum salaries for level three-A teachers;
(3) three million seven hundred forty-nine thousand one hundred thirty dollars ($3,749,130) to provide an additional five percent salary increase to educational assistants; and
(4) thirteen million five hundred fifty-four thousand nine hundred eighty-eight dollars ($13,554,988) to provide a three-fourths percent increase in the employer contribution to the educational retirement fund. The compensation increase shall be effective the first full pay period after July 1, 2006.
D. The department of finance and administration shall distribute a sufficient amount to each agency to provide the appropriate increase for those employees whose salaries are received as a result of the general fund appropriations in the General Appropriation Act of 2006. Any unexpended or unencumbered balance remaining at the end of fiscal year 2007 shall revert to the general fund.
E. For those state employees whose salaries are referenced in or received as a result of nongeneral fund appropriations in the General Appropriation Act of 2006, the department of finance and administration shall transfer from the appropriate fund to the appropriate agency the amount required for the salary increases equivalent to those provided for in this section, and such amounts are appropriated for expenditure in fiscal year 2007. Any unexpended or unencumbered balance remaining at the end of fiscal year 2007 shall revert to the appropriate fund.
