A JOINT MEMORIAL

REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO DIRECT THE APPROPRIATE INTERIM COMMITTEE TO EXAMINE THE APPROPRIATE METHOD TO ENABLE LOCAL GOVERNMENTS THROUGHOUT THE STATE TO OPERATE AND ADMINISTER WATER UTILITY AUTHORITIES.

 

     WHEREAS, it is in the public interest for certain local governments to acquire, improve, maintain and operate water utility authorities; and

     WHEREAS, a general law cannot apply to each local government considering operating and administering a water utility authority, given the number of atypical and special conditions found in each region; and

     WHEREAS, given the complexity of structuring a water utility, it is prudent for an appropriate interim committee to fully explore and address the issues surrounding the development of water utility authorities for those local governments that wish to operate a water utility authority;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the New Mexico legislative council be requested to direct the appropriate interim committee to examine the best method to enable local governments to operate and maintain water utility authorities; and

     BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the co-chairs of the New Mexico legislative council and the state engineer.
