SUMMARY
Synopsis of Bill
Senate Joint Memorial 80 directs HSD to form a task force to study the State’s housing shortages
for persons with serious behavioral health diagnoses or other disabling conditions. It will con-
sider the social issues that may contribute to current housing shortages and homelessness among
New Mexicans, including: poverty; mental illness; issues regarding the young and the elderly, a
person with a police record; and housing shortages for Native American populations.
SJM80 directs the task force to research issues impacting homeless persons and others who lack
stable living situations or adequate housing and to recommend solutions. The task force will
make recommendations aimed at creating affordable housing for all New Mexicans.
Membership of the task force must be comprised of representation from: the state housing au-
thority, the mortgage finance authority, the behavioral health services division of the department
of health, the aging and long-term services department, the interagency behavioral health pur-
chasing collaborative, the protection and advocacy system, consumers and providers.

Significant Issues
Federal regulations do not allow HSD-MAD (Medicaid) to pay for a recipient’s housing needs.
Medicaid covers specific medical care and services, including behavioral health services to eligi-
ble recipients according to “medical necessity.”
