SUMMARY
Synopsis of SRC Amendment
The Senate Rules Committee amendment to Senate Joint Memorial 47 changes the title of the
bill replacing “impose a moratorium” with “adopt provisions”.
Synopsis of Original Bill
Senate Joint Memorial 47 requests the state engineer impose certain limitations on transfers of
mined groundwater out of the basin of origin.
Significant Issues
SJM 47 resolves that the exportation of mined water from a closed groundwater basin be consis-
tent with the public welfare of New Mexico, not contrary to the planning objectives set forth in a
regional water plan, that there must be a demonstrable need to export groundwater, and that there
are no alternative sources of water to supply the region seeking to import groundwater. The
resolution requests the state engineer adopt these provisions as part of the process for evaluating
applications proposing to export groundwater from the Estancia Basin.

TECHNICAL ISSUES
The title of the bill does not agree with the resolution proposed by this joint memorial. A mora-
torium on transfers of mined groundwater would be a cessation of these transfers, whereas the
legislation proposes limitations on such transfers.
