committees of the NM Legislature. The LFC does not assume responsibility for the accuracy of these reports

if they are used for other purposes.

SUMMARY

Synopsis of Bill

Senate Bill 1069 requires the Legislative Finance Committee to determine whether a piece of

proposed legislation requires a “Family Impact Report” and request the appropriate state agency

prepare a family impact report.

Significant Issues

A family impact report shall consider the subject matter of the proposed legislation and provide

information that addresses the 34 areas outlined in section F as appropriate.

FISCAL IMPLICATIONS

This bill does not contain an appropriation; however, there is a potential fiscal impact with pas-

sage of this bill at the agency level and at the LFC.

Senate Bill 1069 will result in agencies such as Children, Youth and Families Department and

the Public Education Department spending a significant amount of time analyzing proposed leg-

islation and preparing a family impact report as requested by the LFC. Agencies are currently

required to submit written analysis within 24 hours of receipt of a request to the LFC. In order to

comply with the 24 hour turnaround and provide a family impact report, state agencies may have

to hire additional staff.

TECHNICAL ISSUES

Senate Bill 1069 amends a statute that pertains to the LFC working with office of the Governor,

Department of Finance and Administration and Taxation and Revenue Department on the dy-

namic forecasting pilot project.

Currently, there is no statute requiring LFC to prepare fiscal impact reports on proposed legisla-

tion. Perhaps it would be more appropriate to amend Section 2-5-3 NMSA 1978 or Section 2-5-

4 NMSA 1978 that pertains to the actual duties and responsibilities of the Legislative Finance

Committee.
