Synopsis of SJC Amendment
The Senate Judiciary Committee amendment removes language that would have required gen-
der-neutral language be used in rules produced by subdivisions of the state.
Synopsis of Original Bill
Senate Bill 1059 appropriates $100 thousand from legislative cash balances to Legislative Coun-
cil Service to revise sections of the NMSA 1978 as required to provide for gender-neutrality in
the language, to make revisions as deemed appropriate and to fund the expenses of the code revi-
sion committee.
Senate Bill 1059 requires that gender-neutral language be used in drafting laws, memorials, reso-
lutions or other documents produced by Legislative Council Service or rules produced by the
legislative, executive or judicial branches or subdivisions of the state. This bill creates a legisla-
tive interim committee call the “Code Revision Committee.”

Significant Issues
The Code Revision Committee shall be composed of 8 members, 4 members from the House of
Representatives and 4 members from the Senate and shall meet no more than four times annu-
ally.
The Code Revision Committee shall report its findings and recommendations for consideration
for any session of any legislature. The report and proposed legislation shall be provided to the
Legislative Council Service on or prior to December 15 preceding the legislative session in
which the code revision committee’s bill is introduced. The committee shall function from the
date of appointment until December 1, 2008.
This bill carries an emergency clause.
FISCAL IMPLICATIONS
The appropriation of $100 thousand contained in this bill is for expenditure in fiscal years 2005
through 2007 and is a nonrecurring expense to legislative cash balances. Any unexpended or un-
encumbered balance remaining at the end of fiscal year 2007 shall not revert to the general fund.
ADMINISTRATIVE IMPLICATIONS
The Legislative Council Service shall provide staff for the code revision committee.
