SUMMARY
Synopsis of Amendment
The Senate Indian and Cultural Affairs Committee amended Senate Bill 1038 as follows:
The amendment re-titles the legislation on page 1, line11 which is technical in nature and
does not change the original intent of the bill.
On page 2, line 21, the amendment strikes most of Item E under Section 1, and inserts
new language that clarifies the original intent of the bill and adds an arbitration option.
The remaining items are technical in nature to agree with the changes proposed by the
amendment.

Senate Bill 1038 amends Section 22-16-4 NMSA 1978.

Senate Bill 1038 adds the following:
A local school district shall provide school bus transportation for any child attend-
ing the schools of the district regardless of whether the location of the student’s
residence is within or outside of the local school district.
School bus routes shall be maintained by a local school district pursuant to Sub-
section B of this section for students residing within or outside of the local school
district, if the student attends a school of the local school district.
Significant Issues
According to PED, if Senate Bill 1038 is enacted it would make school transportation an entitle-
ment for all students attending the districts’ schools and would require districts to transport stu-
dents to school, regardless of residency.
Transportation funds in accordance with section 22-8-26 NMSA 1978 are distributed only for the
purpose of making payments to each school district for the to-and-from school transportation
costs of students in grades K-12 attending public school within the school district.
FISCAL IMPLICATIONS
Senate Bill 1038 does not contain an appropriation. According to PED, transportation services
would increase by approximately 5 % for an estimated FY06 cost impact of $5,000.0.
ADMINISTRATIVE IMPLICATIONS
PED would administer the program through the transportation division.
CONFLICT, DUPLICATION, COMPANIONSHIP, RELATIONSHIP
Senate Bill 1038 conflicts with Section 22-8-26 NMSA 1978.
OTHER SUBSTANTIVE ISSUES
PED indicates that currently districts are authorized to establish temporary transportation bound-
ary agreements with adjoining school districts for the purpose of providing school transportation
services to students residing out-of-district.
Senate Bill 1038 does not address if Per Capita Feeder (mileage reimbursements) to parents may
be utilized.
