SUMMARY
Synopsis of Bill
Senate Bill 368 proposes to amend sections of the Public School Code to reinstate the right of the
local school boards to hire and fire licensed staff.
In Section 2 of the bill, it gives the local school board the duty to “review, approve or reject the
superintendent’s hiring and firing decisions for certified personnel.”
Section 3, clarifies that a local superintendent’s authority to hire, fire and assign salaries to all
employees of the school district does not include certified personnel.
Significant Issues
According to PED, Senate Bill 368 proposes a policy shift from a superintendent as chief execu-
tive officer of a school district to that of a local school board the authority related to hiring, firing
and salary setting of all licensed district personnel including the superintendent.
PED indicates that the bill would invalidate the employment policies put into effect by the Laws
2003, chapter 153.
