SUMMARY
Synopsis of Bill
House Resolution 1 would permit the House of Representatives of the State of New Mexico to
express its support for the Federal Employee Free Choice Act that has been introduced in the
United States Congress.
Significant Issues
Authorizes the National Labor Relations Board to certify a union as the bargaining repre-
sentative of employees when a majority of employees voluntarily sign an authorization
designating that union to represent it;
Provides for first contract mediation and arbitration;
Establishes meaningful penalties for violations of a worker’s freedom to choose a union;
Urges Congress to pass the Employee Free Choice Act;
Copies of this resolution are to be transmitted to the members of the New Mexico Congressional
delegation

PERFORMANCE IMPLICATIONS
According to PED, HR 1 will not have an impact on the Public Education Department (PED) or
New Mexico schools since employees are permitted to unionize in accordance with state and
federal law.
