SUMMARY
Synopsis of Amendment
The House Judiciary Committee amendment removes the reference to “legislature” and replaces
it with “legislative” on page 2, line 24. This clarifies in the proposed legislation that a copy of
the memorial is to be transmitted to the New Mexico Legislative Council.
Synopsis of Original Bill
House Joint Memorial 42 has the New Mexico Legislative Council direct an appropriate interim
legislative committee to study the details of the San Juan DWI treatment program and how that
program might be replicated in other areas of the state. Also, the study is to pay specific atten-
tion to the effect and value of treatment during the incarceration period and post-incarceration
monitoring.
OTHER SUBSTANTIVE ISSUES
NMCD states the joint memorial does not clarify which state agencies would be responsible for
handling the post-release monitoring component of the study if it was implemented statewide.

NMCD reports they do not generally take any offenders into custody for periods of less than one
year; however, if the Department would be required to implement and maintain any portion of
post-release monitoring, it could result in a substantive fiscal and administrative impact on the
Department.
