committees of the NM Legislature. The LFC does not assume responsibility for the accuracy of these reports

if they are used for other purposes.

SUMMARY

Synopsis of Bill

House Joint Memorial 35 resolves that PED provide a report on:

•

The amount of federal funding the state has been eligible for and the amount the state has

received pursuant to the No Child Left Behind (NCLB) act of 2001;

•

How the money has been spent by PED, including in which school districts and for what

purposes;

•

Whether any money has been returned to the federal government, and, if so, the amount

and the reasons for return; and

•

Whether any money for which the state was eligible was not received or expended and, if

so, the reasons it was not.

The joint memorial further resolves PED report the findings to the appropriate interim by July 1,

2005. A copy of the joint memorial is to be sent to the Secretary, PED.

Significant Issues

PED states funds were made available under NCLB on July 1, 2002 with 27 months for obliga-

tion. The initial funds could be obligated through September 30, 2004. Due to the extended

timeframe for obligating funds, PED would only be able to provide a report of use of funds for

grants made available under federal fiscal year 2002 (school year 2002-03).

PED is currently conducting, along with a number of other states, an analysis of costs associated

with implementation and administration of NCLB. No estimate of when the analysis will be

completed was provided.

PERFORMANCE IMPLICATIONS

According to PED, most of the federal grants have a goal of improved academic achievement in

reading and math which directly related to performance measures in public school support.

FISCAL IMPLICATIONS

No appropriation is provided and PED states a data collection will need to be developed with an

estimated cost of $6 thousand.

OTHER SUBSTANTIVE ISSUES

DFA, Office of Education Accountability, has provided some information to the Legislature of

Title I and Title II and the amount of funds provided to school districts to meeting some of the

NCLB requirements.

ALTERNATIVES

PED would like the due date extended until January 2006 so an appropriate data collection

mechanism can be designed that will provide a more comprehensive report of requested informa-

tion. DFA suggests December 2005 as the date for the report.
