SUMMARY
Synopsis of HAFC amendment
The House Appropriation and Finance Committee amendment to House Bill 1039 deletes the
appropriation. Senate Bill 190 includes a $330 thousand appropriation contingent upon passage
of HB 1039.
Synopsis of Original Bill
House Bill 1039 appropriates $500 thousand from the general fund to PED for the purpose of
holding the Roswell Independent School District (RISD) harmless for loss of admission revenue
from athletic events during a pilot project through FY2009 to determine if juvenile delinquency
is reduced, student and parent participation increased, and overall attendance at athletics events
is increased by providing free admission. PED and RISD will provide periodic reports to the
LESC and other interim committees of the Legislature, and issue a final report to the Governor
and Legislature by December 1, 2008.

Significant Issues
AOC states it is unknown if this project would reduce or change caseload in Chaves County
children’s court which would need to assist in the data collection effort.
CYFD assess “the research project could be more informative if it distinguishes between youth
already involved in the juvenile justice system in contrast to youth with no juvenile system his-
tory.”
PERFORMANCE IMPLICATIONS
AOC has three performance measures that could be impacted by this project:
1.
Cases disposed as a percent of cased filed;
2.
Percent change in case filings by type; and
3.
Clearance rate.
FISCAL IMPLICATIONS
The appropriation of $500 thousand contained in this bill is a non-recurring expense to the gen-
eral fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009
shall not revert.
PED assesses its cost to administer the program at $5.2 thousand to pay for 160 hours of an edu-
cation administrator’s salary and benefits.
ADMINISTRATIVE IMPLICATIONS
PED will have to work with RISD to determine fiscal trend data for the following for NMAA
sanctioned events:
Student participation;
Student attendance;
Parent attendance; and
Overall attendance.
PED will have to work with CYFD and the Chaves County Children’s Court to obtain juvenile
delinquency statistics and assess whether the free admission resulted in a reduction in incidents.
