Synopsis of Bill
The House Judiciary Committee Substitute for House Bill 1000 requires a person who files a lien
with the county clerk to serve the owner of the property, either in person or by priority mail with
delivery confirmation, a statement to notify the property owner of the claim. When the person
files the lien with the county, the claim shall also contain a statement that a copy of the lien has
been served upon the property owner.
FISCAL IMPLICATIONS
Because this bill puts the notification burden on the individuals filing the claim of lien, there is
no fiscal impact to the state.
OTHER SUBSTANTIVE ISSUES
Property owners may be unaware that a lien has been filed against their property. This bill
would provide a means for notifying the property owner of the claim. The costs of preparing and
delivering the notice are borne by the individual filing the claim. County clerks may require mi-
nor administrative changes to ensure that the required statement of notification is included in the
claim of lien.
