SUMMARY
Synopsis of Bill
House Bill 908 allows the secretary of public safety to enter into reciprocity agreements with
other states to recognize a concealed handgun license of that state. To enter into such an agree-
ment, the Department of Public Safety must make a determination that the other state’s licensing
process contains a background check requirement that is at least as thorough as New Mexico’s.
The other state’s concealed handgun license would be recognized in New Mexico if New Mex-
ico’s license is also recognized in that state. If New Mexico enters into a reciprocity agreement
with another state under this section, a holder of such license shall have the same privileges and
obligations as a licensee pursuant to New Mexico’s Concealed Handgun Carry Act.

Significant Issues
The AGO notes that current law directs the Department of Public Safety to promulgate rules re-
garding the authority for the transfer of a concealed handgun license issued by another state.
The AOC notes that the bill requires the other state to have a similar background check require-
ment to New Mexico’s but does not require the other state to have a mandatory firearms training
course as New Mexico does.
FISCAL IMPLICATIONS
The bill will result in minimal costs to the Department of Public Safety to establish a process for
entering into reciprocal agreements.

House Bill 908 conflicts with House Bill 641, which makes a number of changes to the law re-
garding concealed handguns and includes a provision regarding reciprocal agreements. House
Bill 908 relates to House Bill 377, which allows judges to carry concealed handguns in court-
houses.
