SUMMARY
Synopsis of HAGC Amendment
The House Agriculture and Water Resources Committee amendment to House Bill 591 makes
technical corrections to the boundary description and specifies that Santa Ana pueblo reservation
is not included as part of the northern boundary.
The amendment adds a temporary provision specifying that nothing in the boundary revision
shall be construed to release a citizen or property from indebtedness owed on the effective date
of the act.
Significant Issues
The temporary provision is necessary in that the southern boundaries of the authority are
changed as a result of the annexation of a portion of Bernalillo county by Sandoval county. Citi-
zens and property located within this area may owe assessments to the Albuquerque Metropoli-
tan Flood Control Authority. This debt remains in effect until it is paid.

Synopsis of Original Bill
House Bill 591 revises the boundaries of the Southern Sandoval County Flood Control Authority
to account for added area gained as a result of annexation of a portion of land previously within
Bernalillo County and presently in Sandoval County. This bill also specifies the northern
boundary more particularly to accurately define that no portion of the Santa Ana Indian reserva-
tion lies within the authority boundaries.
Significant Issues
The authority notes that when the initial survey was completed in 1989 mapping technology did
not allow for the accuracy now available leading to some of the boundaries falling into areas not
covered by the authority, HB 591 corrects these inaccuracies. In addition, Santa Ana pueblo was
concerned that portions of their land fell within the authority boundaries, this bill also addresses
these concerns.
FISCAL IMPLICATIONS
The authority will receive additional funds as a result of the annexation of land from Bernalillo
County. This will not be realized immediately as an agreement between the Albuquerque Met-
ropolitan Area Flood Control Authority and Southern Sandoval County Flood Control Authority
allows for a period of time until new taxes are collected.
