SUMMARY
Synopsis of Bill
House Bill 396 appropriates $122,600 from the general fund to Public Education Department for
the purpose of funding special programmatic needs of the Espanola Valley Military Academy, a
charter school, to allow it to enter into coordinated activities with the New Mexico National
Guard.
PERFORMANCE IMPLICATIONS
DMA states the proposed legislation is unclear in regards to “coordinated activities” with the Na-
tional Guard. The agency is unclear as to what their performance targets are in regards to this
proposed legislation.
FISCAL IMPLICATIONS
The appropriation of $122,600 contained in this bill is a non-recurring expense to the general
fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2006 shall
revert to the general fund.

PED reports the New Mexico National Guard receives federal funds and some state general
funds to support military and civilian activities that maintain a high degree of readiness to re-
spond to state and federal missions. PED states the National Guard does not have the resources
to support their partnership with the Espanola Military Academy.
ADMINISTRATIVE IMPLICATIONS
PED states the Espanola Military Academy is located on the grounds of the Espanola National
Guard Armory, and utilizes three full-time National Guard staff as military instructors/education
aides.
PED reports the proposed legislation would allow them to provide additional support to the Es-
panola Military Academy for special programmatic activities in partnership with the National
Guard.
TECHNICAL ISSUES
PED states lines 12 and 20 of the proposed legislation should read “Espanola Military Academy”
and not “Espanola Valley Military Academy”.
