SUMMARY
Synopsis of Bill
House Bill 232 expands the definition of “formally charged” to allow for the filing of a criminal
complaint for a misdemeanor listed in Subsection B of NMSA 1978, Section 31-26-3, Victims of
Crime Act.
Significant Issues
By expanding the filing of a criminal complaint for a misdemeanor listed in the Victims of Crime
Act, it makes it clear that the Act applies to those misdemeanor crimes.
FISCAL IMPLICATIONS
There might be a very minimal increase in prosecutions for the District Attorneys. Not all mis-
demeanor cases are prosecuted by the District Attorneys.
