SUMMARY
Synopsis of Bill
House Bill 101 adds new language to the Family Violence Protection Act to allow a victim of
domestic violence, or a victim’s representative, who has good reason to believe that the victim’s
safety is at risk to apply to the Secretary of State for the use of the SOS as a substitute address.

The application shall be on a form provided by the SOS and shall include:
(1)
a statement that the SOS is acting as an agent of the victim for the purposes of
the forwarding of mail
(2)
a new mailing address for forwarding received mail and a telephone number
where the victim can be contacted by the SOS
(3)
payment of a $75.00 application fee, which may be waived if the applicant is
indigent; and
(4)
the signature of the victim or the victim’s representative.
Significant Issues
The SOS notes that the New Mexico court system is currently the entity to determine whether a
victim is at risk and in need of a substitute address. Since the court systems in New Mexico are
experiencing severe backlogs due to an ever increasing volume of caseload, the SOS believes the
substitute address program should be administered in her office in order to relieve the courts of
this burden.
The SOS intends to develop a procedure to process applications.
FISCAL IMPLICATIONS
The $75.00 fee, as currently worded, is a one-time fee and will be sufficient to cover the ex-
penses of administration.
ADMINISTRATIVE IMPLICATIONS
The SOS is already engaged in the activity of collecting and forwarding of mail for the 33 county
clerks.
