AN ACT

RELATING TO TELECOMMUNICATIONS; PROVIDING FOR A TIME LIMIT ON CHARGES FOR PUBLIC TELECOMMUNICATIONS SERVICES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the New Mexico Telecommunications Act is enacted to read:

     "[NEW MATERIAL] TIME LIMIT ON CHARGES FOR PUBLIC TELECOMMUNICATIONS SERVICE.--

          A. A telecommunications company, mid-size carrier or incumbent rural telecommunications carrier that provides a public telecommunications service to a customer is prohibited from charging the customer for the service if a period of more than six months elapses before the customer is billed for the service.

          B. As used in this section, "incumbent rural telecommunications carrier" means a local exchange carrier that serves fewer than fifty thousand access lines within the state and was designated as an eligible telecommunications carrier by the public regulation commission on or before November 1, 1997, including any successor in interest thereto."

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2005.
