Madam President:
Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred
SENATE BILL 1051
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 4, line 17, after "polysomnographic-related" insert "respiratory".
2. On page 5, strike lines 4 through 22 in their entirety and insert in lieu thereof:
"J. "polysomnography-related respiratory care services":
(1) means the limited practice of respiratory care in the provision of polysomnographic services by a:
(a) polysomnographic technologist under medical direction;
(b) polysomnographic technician, under the supervision of a New Mexico licensed physician or a polysomnographic technologist;
(c) polysomnographic trainee, under the supervision of a New Mexico licensed physician or a polysomnographic technologist; or
(d) person who is licensed by the department as a respiratory care practitioner; and
(2) are limited to the therapeutic and diagnostic use of oxygen, noninvasive ventilatory assistance of patients who spontaneously breathe when awake, the application and monitoring of pulse oximetry and capnography and the education of patients about using and complying with the preceding procedures as ordered by a New Mexico licensed physician or by written procedures and protocols of the associated sleep disorders center or laboratory as approved by a New Mexico licensed physician and that do not violate regulations adopted by the department in consultation with the board;".
3. On page 6, between lines 19 and 20, insert the following new subsection:
"C. A polysomnographic technologist may transcribe and implement the written or verbal orders of a New Mexico licensed physician or other person authorized by law to prescribe pertaining to the practice of polysomnography-related respiratory care and respiratory care protocols.".
4. Renumber the succeeding subsections accordingly.
5. On page 14, between lines 2 and 3, insert the following new subsection:
"C. The department, in consultation with the board, may adopt rules for the issuance of temporary permits to students and graduates of approved polysomnography training programs and to polysomnographic trainees to practice polysomnography-related respiratory care services under the direct supervision of a polysomnographic technologist, respiratory care practitioner or a New Mexico licensed physician.".
6. Renumber the succeeding subsections accordingly.,
and thence referred to the CORPORATIONS AND TRANSPORTATION COMMITTEE.
