AN ACT

RELATING TO EDUCATION; ESTABLISHING MAXIMUM PAYMENTS TO HEARING OFFICERS IN SPECIAL EDUCATION DUE PROCESS HEARINGS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 22, Article 13 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] MAXIMUM PAYMENTS FOR DUE PROCESS HEARING OFFICERS ESTABLISHED.--The department shall pay hearing officers in special education due process hearings pursuant to the federal Individuals with Disabilities Education Act a maximum of five thousand dollars ($5,000) per case and shall provide yearly training and support on case and time management to such hearing officers."
