AN ACT

RELATING TO LAW ENFORCEMENT; ESTABLISHING A STANDARD ARREST REPORT FOR DRIVING WHILE UNDER THE INFLUENCE OF INTOXICATING LIQUOR OR DRUGS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. UNIFORM POLICE REPORTS FOR DWI ARRESTS.--

          A. The department of public safety, in collaboration with the motor vehicle division of the taxation and revenue department, shall develop and periodically review and update a standard arrest report to be used by law enforcement officers when making an arrest for a violation of the provisions of Section 66-8-102 NMSA 1978.

          B. A law enforcement officer making an arrest for a violation of the provisions of Section 66-8-102 NMSA 1978 shall use the standard arrest report developed and approved by the department of public safety and the motor vehicle division of the taxation and revenue department.
