Your CORPORATIONS AND TRANSPORTATION COMMITTEE, to whom has been referred
SENATE BILL 634
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 4, line 4, after "may" insert ", with cause".
2. On page 4, line 6, strike ", or both" and insert in lieu thereof "pertaining to public works prevailing wage projects".
3. On page 7, line 20, after "have" remove the brackets and line-through.
4. On page 9, line 3, after "damages" insert "beginning with the first day of covered employment".
5. On page 9, lines 3 and 4, remove the brackets and line- through and strike "ten dollars ($10.00)" and insert in lieu thereof "one hundred dollars ($100)".
6. On page 9, lines 4 and 5, strike "up to three times the actual amount of underpaid wages when the".
7. On page 9, line 7, remove the brackets and line-through.
8. On page 9, strike lines 10 through 14 in their entirety and insert in lieu thereof the following new subsection:
"D. In an action brought pursuant to Subsection C of this section, the court may award, in addition to all other remedies, attorney fees and costs to an employee adversely affected by a violation of the Public Works Minimum Wage Act by a contractor, subcontractor, employee or a person acting as a contractor."".,
and thence referred to the JUDICIARY COMMITTEE.
