    Your JUDICIARY COMMITTEE, to whom has been referred

SENATE BILL 515, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 3, line 13, after the second occurrence of "area" insert "where smoking may be permitted as".

    2. On page 3, lines 15 and 16, strike "where smoking is permitted".

    3. On page 8, line 2, strike "whenever it is not" and insert in lieu thereof "during hours of business operation while it is".

    4. Strike Senate Corporations and Transportation Committee Amendment 2.

    5. On page 8, between lines 5 and 6, insert a new subsection to read:

    "C. a facility of a tobacco product manufacturer;".

    6. On page 8, line 17, strike "and".

    7. On page 8, line 21, strike the period and the ending quotation marks and insert in lieu thereof "; and" and between lines 21 and 22, insert the following new subsection to read:

         "K. enclosed areas within restaurants and hotel and motel conference or meeting rooms while these places are being used for private functions; provided that none of these areas are open to the general public while the private functions are occurring and provided that smoke does not infiltrate other enclosed indoor workplaces or public places where smoking is otherwise prohibited under the Clean Indoor Air Act."".

    8. On page 9, line 22, after the period insert the ending quotation marks.

    9. On page 9, line 23, strike "C." and insert in lieu thereof the following:

    "Section 7. A new section of the Clean Indoor Air Act is enacted to read:

    "[NEW MATERIAL] POSTED SMOKEFREE AREAS.--".

    10. On page 10, line 1, strike the paragraph designation "(1)" and insert in lieu thereof the subsection designation "A.".

    11. On page 10, line 3, after the comma insert "a".

    12. On page 10, strike lines 4, 5 and 6 in their entirety and strike line 7 through the comma and insert in lieu thereof "sign".

    13. On page 10, line 14, strike the paragraph designation "(2)" and insert in lieu thereof the subsection designation "B.".

    14. On page 10, line 15, after the comma insert "a" and strike "signs" and insert in lieu thereof "sign".

    15. On page 10, line 16, after the closing quotation marks, strike the remainder of the line, strike lines 17 and 18 in their entirety and strike line 19 through the first comma.

    16. On page 10, line 25, strike the paragraph designation "(3)" and insert in lieu thereof the subsection designation "C.".

    17. On page 11, line 3, strike the paragraph designation "(4)" and insert in lieu thereof the subsection designation "D.".

    18. Renumber the succeeding sections accordingly.
