AN ACT

RELATING TO PUBLIC HEALTH; PROHIBITING SMOKING ON THE PREMISES OF CORRECTIONAL FACILITIES AND ON PUBLIC SCHOOL CAMPUSES; REQUIRING POSTING OF SIGNS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. SMOKING--PROHIBITION--CORRECTIONAL FACILITIES--PUBLIC SCHOOL CAMPUSES.--

          A. It is unlawful for any person to smoke on:

                (1) the premises of a correctional facility operated by the corrections department;

                (2) the premises of a publicly or privately operated correctional facility that houses inmates lawfully committed to the corrections department; and

                (3) a public school campus.

          B. To advise persons that smoking is prohibited, signs using the words "No Smoking" or the international no-smoking symbol or both shall be posted either on all public entrances to the facility or school or in a position where the sign is clearly visible upon entry onto the facility's premises or the school campus.

          C. A person who violates the provisions of Subsection A of this section is guilty of a misdemeanor and shall be sentenced in accordance with provisions of Section 31-19-1 NMSA 1978.

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2005.
