    Your FINANCE COMMITTEE, to whom has been referred

SENATE BILL 258

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 1, line 13, after "COMMITTEE", strike the semicolon and strike line 14 up to the period.

    2. On page 2, line 21, after "provides", insert "for the care and maintenance of indigent persons in New Mexico through" and strike "to".

    3. On page 2, line 22, strike "indigent persons in New Mexico".

    4. On page 3, lines 3 and 4, strike "an attorney who meets the requirements of the Public Service Law Loan Repayment Act" and insert in lieu thereof "a participating attorney as consideration and inducement to the attorney to engage in public service employment".

    5. On page 4, line 20, strike "and".

    6. On page 4, line 21, strike "declare an intent to".

    7. On page 4, line 22, after the semicolon, insert "and".

    8. On page 4, between lines 22 and 23, insert the following new subparagraph:

                  "(d) work in public service employment in underserved areas of New Mexico that are in greatest need of attorneys practicing in public service employment;".

    9. On page 6, lines 6 through 8, strike "provide for the payment by the state of a stated sum to the participating attorney's legal education debtors and shall".

    10. On page 6, line 8, after "the", insert "amount of the award and the".

    11. On page 6, line 19, strike "may" and insert in lieu thereof "shall".

    12. On page 6, line 24, after the period, insert:

    "If the commission does not find acceptable extenuating circumstances for the participating attorney's failure to comply with the contract, the commission shall require immediate repayment of the award plus the amount of the penalty.".

    13. On page 7, line 3, strike "to the lenders of participating attorneys".

    14. On page 9, strike Section 12 in its entirety.
