AN ACT
MAKING AN APPROPRIATION TO THE NEW MEXICO SENTENCING COMMISSION FOR A WORKLOAD MEASUREMENT STUDY ON EQUITABLE RESOURCE NEEDS OF THE PUBLIC DEFENDER DEPARTMENT, DISTRICT ATTORNEYS AND STATE COURTS; DECLARING AN EMERGENCY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. APPROPRIATION.--Four hundred fifty thousand dollars ($450,000) is appropriated from the general fund to the New Mexico sentencing commission for expenditure in fiscal years 2005 and 2006 to contract for a workload measurement study that analyzes and makes recommendations regarding equitable statewide resource needs of the public defender department, district attorneys and state courts. The New Mexico sentencing commission shall be required to update the workload measurement study not less than every five years following completion of the initial study. Any unexpended or unencumbered balance remaining at the end of fiscal year 2006 shall revert to the general fund.
Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
