AN ACT

RELATING TO EDUCATION; REQUIRING THAT NON-UNITED STATES CITIZENS ARE CLASSIFIED AS RESIDENTS OR NONRESIDENTS OF NEW MEXICO ON THE SAME BASIS AS UNITED STATES CITIZENS FOR TUITION PURPOSES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 21, Article 1 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] STATE EDUCATIONAL INSTITUTIONS--NON-UNITED STATES CITIZENS.--

          A. For the purpose of tuition payment at the resident or nonresident student rates at state educational institutions, as defined in Article 12, Section 11 of the constitution of New Mexico, a non-United States citizen who is lawfully in the United States shall be classified as a resident or a nonresident on the same basis as a citizen of the United States.

          B. For purposes of this section, "non-United States citizen" means a person and the person's children who are not citizens of the United States."
