AN ACT

RELATING TO LICENSURE; AMENDING THE PUBLIC HEALTH ACT; RESTRICTING THE ADMINISTRATION OF ULTRASONOGRAPHY OR ULTRASOUND; PROVIDING FOR PENALTIES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Public Health Act is enacted to read:

     "[NEW MATERIAL] RESTRICTION--ADMINISTRATION OF ULTRASONOGRAPHY OR ULTRASOUND--PENALTIES.--

          A. The administration of any ultrasonography or ultrasound on a person is restricted to that performed pursuant to an order or referral by a licensed physician, nurse practitioner, certified nurse midwife or physician assistant.

          B. A person who violates Subsection A of this section is guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than one hundred dollars ($100) or more than one thousand dollars ($1,000) or by imprisonment of less than one year, or both."
