    Your JUDICIARY COMMITTEE, to whom has been referred

HOUSE BILL 739, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. Strike all House Transportation Committee amendments.

     2. On page 5, line 10, after “carrier” insert “of persons”.

     3. On page 5, line 11, after the first occurrence of “the”, strike the remainder of the line and insert “customer pays either directly or indirectly and that transports passengers in conjunction with the primary service that it provides;”.

     4. On page 5, strike lines 12 through 14 in their entirety.

     5. On page 12, line 6, after the period insert "Rules regarding financial responsibility of incidental carriers shall be adopted by July 1, 2006 by the commission, and implementation of the financial responsibility requirements for incidental carriers shall begin on July 1, 2006.".
