AN ACT

RELATING TO ELECTIONS; PROHIBITING CERTAIN RELATIVES OF COUNTY CLERKS FROM SERVING ON ABSENT VOTER PRECINCT BOARDS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Absent Voter Precinct Act is enacted to read:

     "[NEW MATERIAL] ABSENT VOTER PRECINCT BOARD--QUALIFICATION OF MEMBERS.--An absent voter precinct board member shall have the same qualifications as precinct board members; provided, however, that an absent voter precinct board member shall not be a spouse, parent, child, brother or sister of the county clerk of the county in which the absent voter precinct is created." 

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2005.
